ARTICLE 1. SCOPE OF APPLICATION

The general conditions of sale detailed below (hereinafter referred to as the "General Conditions") govern the contractual relations between any user of the Islandpics.art site (hereinafter referred to as a "User" or "You") and the commercial brand IslandPics belonging to the company SUNSEE SARL with a capital of 500 EUROS, whose head office is located at 33 Tivoli, Post-Colon, 97234 Fort-de-France and registered in the trade and companies register of Fort-de-France under number 828 319 665 (hereinafter referred to as "Islandpics.art").
These general terms and conditions of sale are the only ones applicable and replace all other conditions, unless prior, express and written exemption. Islandpics.art may occasionally modify certain provisions of its general terms and conditions, so it is necessary that these are reread before each visit to the Islandpics.art site (hereinafter referred to as the "Site"). These modifications are binding from the date they are posted online (the date of posting appearing at the end of these conditions) and cannot apply to contracts concluded previously. Each purchase on the Site is governed by the general terms and conditions applicable on the date of the order. By validating your order, you unreservedly accept the General Terms and Conditions after having read them. By accessing the Site, you agree to comply with these conditions.
It is specified that these conditions govern the sales of IslandPics photo boards and frames on the Site.

 

ARTICLE 2. USE OF THE SITE

To use the Site, you must be at least 18 years old, legally capable of entering into a contract, and use this Site in accordance with these Terms and Conditions. You guarantee the truthfulness and accuracy of the information you provide on this Site.
 Islandpics.art reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding payment for a previous order.
The Site is available in French and English.

1) Essential characteristics of the products

The products sold on the Site are photos printed on canvas on wooden or aluminum frames, or posters.
 Photographs are available in one or more formats.
 Prices are shown inclusive of all taxes, excluding shipping costs.
 Only payments in euros are accepted.
In the event of delivery to a country other than mainland France, you are the importer of the work(s) concerned. For all works shipped outside the European Union and French overseas territories, customs duties or other local taxes, import duties, or state taxes may be payable.
 These fees and amounts are not the responsibility of Islandpics.art. They will be your responsibility and are your sole responsibility both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.

Islandpics.art reserves the right to change its prices at any time. Works will be invoiced based on the rates in effect at the time of order placement, subject to availability.
 The works remain the property of Islandpics.art until full payment of the indicated price.

2) Place an order

To place an order, you must at least go through the following steps:

  • View the file presenting a photograph. On this screen you can choose the format offered for this photograph. You must click on "Add to cart" to add this item to your cart.
  • “Basket” screen: you have the option to delete an item or modify the quantities ordered.
     • Screens for identification or creation of a customer account
     • Delivery method selection screen. On this screen, you will find a link to modify the items in your order.
    • Summary screen and payment options. This screen allows you to choose your payment method and check the various elements of your order (items, quantity, delivery method, total price). You must ensure that all these elements comply with your request. Using the links on this screen, you can modify your order.
  • You must then accept these general terms and conditions of sale and use of the Site to proceed to the payment stage. The conditions are available for reading and printing from the link entitled "general terms and conditions of sale". Their acceptance is made by checking the box affixed to the link to these conditions. The general terms and conditions of sale and use of the Site must be accepted with each order.
     • You pay for your order using the chosen payment method
     • The contract is concluded upon confirmation of payment by the bank.
    • The Site will send you confirmation of your order by email within a few minutes.

3) Payment methods

Several payment methods are available to you to pay for your order on the Site:

  • Credit card, virtual credit card, Visa, Mastercard.
  • payment in installments with our partner ALMA

 

4) Payment security

For credit card payments, the transaction is carried out by STRIPE
 The User's banking data is encrypted (SSL technology, Secure Socket Layer). It does not circulate unencrypted on the internet and cannot be intercepted.
 Your banking details (card number, expiry date, etc.) are not communicated to Islandpics.art.

5) Proof

The data recorded by the Site constitutes proof of all transactions between the Site and its customers.
The data recorded by the STRIPE payment system constitutes proof of financial transactions.

6) Delivery

Order processing

Orders are fulfilled on a just-in-time basis as they are received. The manufacturing lead time is one week.

7) Delivery address

Islandpics.art book:

  • in mainland France
  • in Martinique
  • in Germany
  • in Austria
  • in the Netherlands
  • in Belgium
  • in the USA

Delivery will be made to the delivery address that you confirmed at the time of ordering as the “delivery address”, which may be different from the “billing address”.

Changing the delivery address after placing the order is not possible for logistical reasons.

8) Delivery methods and deadlines

Possible delivery methods depend on the quantity, size of the item(s) ordered, and the country of delivery. If your order includes items of different sizes, the size of the largest item will be taken into account. Islandpics.art reserves the right to choose the carrier.

The delivery date depends on the order dispatch date and the delivery time induced by the delivery method.

Estimated delivery times are 6 (six) to ten (10) working days (excluding Saturdays, Sundays and public holidays) from the sending of the Delivery Confirmation Email.
From receipt of the order, payment and preparation of the product until delivery, the minimum delivery time is 13 working days (excluding Saturdays, Sundays and public holidays). The delivery time may be slightly longer when the products have to be delivered to areas with difficult access. For Deliveries to a delivery point, an email will be sent to you as soon as your package arrives at the delivery point of your choice.
 From the day of delivery, you can collect the package upon presentation of proof of identity.
Although we make every effort to deliver your products within the timeframes defined above, delivery dates are only estimates, they are not guaranteed, and they cannot be invoked against us. However, the maximum period of thirty (30) days from the date of receipt of the Delivery Email is guaranteed.

 

9) Taxes and customs fees outside the European Union

Items shipped outside the European Union or continental Europe may be subject to taxes, customs duties, and other charges in the destination country, hereinafter referred to as "Import Fees." The recipient of the order agrees by placing an order to be designated as the importer of record in the country where the order is received and is responsible for the import fees. For each item imported, you authorize Islandpics.art to designate a carrier to act as an intermediary with the competent authorities for the management and settlement of import fees in the destination country. You also agree by placing an order that the carrier may share with Islandpics.art the amount of these import fees. In the case of an order placed as a gift or as an intermediary for another person, you agree to give the above authorizations on behalf of the recipient designated in your order. To obtain details of actual import charges, or to obtain documents or receipts related to customs clearance, you may contact the designated carrier indicated in your shipment confirmation.

10) Receipt of delivery

Upon receiving your order, it is your responsibility to open the package to check the condition of the photographs or frames. If you are not personally receiving the package, ask the person in charge of receiving the package to do this check.
 In the event of a problem, please hand your package over to the delivery person (La Poste or private carrier) stating the problem encountered and contacting our customer service the same day.
 Do not sign the delivery slip if the order arrives damaged. No claims will be accepted if the delivery slip is signed.
In the case of delivery by private carrier, the carrier is not required to deliver inside your home and may hand over the package to you at the entrance to your building or house.
 We therefore advise you to arrange for help to carry the package into your home for large frames.

The receipt of the transported objects extinguishes any action against the carrier for damage or partial loss if within three days, not including public holidays, following that of this receipt, the recipient has not notified the carrier, by extrajudicial act or by registered letter, of his reasoned protest. (art L 133.3 of the Commercial Code).

11) Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, you have the right to return any work that does not suit you. This right does not apply to orders placed by companies.

For any order on the Site, you have 15 calendar days to notify us of your return request.

To do this, please contact our customer service who will give you the return address and you will then have 14 days to return your order to us.

  • If your order was delivered by post (Colissimo, Chronopost), you can return your order to us by post (return costs at your expense).
    • If your order was delivered by a carrier, they will pick up your order.
     This service will be charged to you at the same price as the initial delivery charge.

No cash on delivery shipments will be accepted, whatever the reason.

Items returned without their original packaging or incomplete, damaged, damaged or soiled by the customer will not be accepted. Return shipping costs are your responsibility.

Islandpics.art will refund the price of the returned items and the original shipping costs (return shipping costs are your responsibility) within 14 days of receipt of the items or receipt of proof of shipment. This refund will be made by credit to the bank account used for payment, by bank transfer, or by check.

ARTICLE 3. FORCE MAJEURE

Pursuant to Article 1148 of the Civil Code, Islandpics.art cannot be held liable or considered to have committed a fault in the processing of your file, if any delay or non-performance results from a case of force majeure.

ARTICLE 4. LIABILITY AND WARRANTIES

SUNSEE SARL strives to ensure, to the best of its ability, the accuracy and updating of the information published on this site, the content of which it reserves the right to correct at any time and without notice.

This site may contain links to other sites. SUNSEE SARL cannot be held responsible for any problems accessing or relating to the content of these sites.

SUNSEE SARL will not be liable for any damages arising from the use or inability to use the Site.

SUNSEE SARL shall not be liable in any way for malfunctions attributable to software, whether or not incorporated into the Site or provided with it.

SUNSEE SARL undertakes to respect all legal guarantees to which you may be entitled. In the event of defects in the goods, you benefit from the legal guarantees provided for by the legislation in force. As the works presented on our site comply with the requirements of French law, we cannot be held responsible for the violation of the legislation specific to the country of delivery of the work. Therefore, we invite you to familiarize yourself with the law in force in the country of delivery.

You benefit from the guarantees listed in this article 5 only to the extent that the products were purchased directly on the Website.

You benefit from the legal guarantee of conformity (articles L. 217-4 et seq. of the Consumer Code),

If your products are non-compliant (for example, if they do not match the description given on the site or your order), you have a period of two years from delivery of the goods to contact our Customer Service by email at the following address contact@Islandpics.art, or by post to the following address: SUNSEE SARL, 33 Tivoli, Post-Colon, 97234 Fort-de-France, and return the non-compliant products to us. We will then send you replacement products. If we are unable to replace the non-compliant products within thirty (30) days, you can:

– request a full refund for non-compliant products or
– keep the non-compliant products and ask us for a reduction of part of the price, which will be determined on a case-by-case basis.

ARTICLE 5. INTELLECTUAL PROPERTY

1) Rights to the work

The artist, having taken the initiative of his creation, remains the owner of the copyright on his creation, within the meaning of French law. The rights of representation and reproduction of the works present on the Islandpics.art site belong to their authors and to SUNSEE SARL. Their joint authorization is necessary for any exploitation of these rights. Your rights on the purchased work are therefore limited to a right of private use, excluding any right of representation and reproduction.

2) Intellectual property rights

All elements present on the site and the site itself are protected by copyright, trademark law, design law and/or any other intellectual property right. By elements, we mean, but are not limited to: photographs, images, drawings, illustrations, texts, videos, logos, screen savers, wallpapers, brands, models, software... These elements belong to the company SUNSEE SARL or are used with the agreement of their owners.
As such, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, partial or complete by any process and on any medium whatsoever (paper, digital, etc.) is prohibited without the prior written authorization of SUNSEE SARL, except for the exceptions referred to in Article L 122.5 of the Intellectual Property Code, under penalty of constituting an offense of infringement of copyright and/or designs and models and/or trademark, punishable by two years' imprisonment and a fine of €152,449.02.

ARTICLE 6. APPLICABLE LAW

These terms and conditions are governed by French law. They are available in the language in which the Site is viewed, see art. II. In the event that a dispute arises from this contractual relationship, the User and SUNSEE SARL undertake to seek an amicable solution before any legal action.

 In the event of a dispute, only the French courts will have jurisdiction.
